Terms of service.

As a condition of your use of this Platform, you warrant that:

• All information you provide on the Platform is correct, accurate and complete. Keep data about your job search correct and up to date. You will also inform us as soon as possible if your situation or wishes regarding work change.

• You will provide brief feedback to interested employers who contact you regarding the suitability of their offer.

• You will inform employers in a timely manner if you cannot attend an agreed trial day or job interview, or if you ultimately cannot accept an offered position.

• If you have an account with takeoff.healthcare GmbH, you will protect your account credentials and not make them available to third parties.

• You are authorised to enter into this Agreement and you use this Platform in accordance with all conditions stated herein.

Takeoff.healthcare GmbH does not knowingly collect data from persons under the age of 16. We reserve the right to refuse access to this Platform and the Services we offer at our sole discretion, for any reason, including breach of this Agreement.

No charges are made for using the Platform in accordance with these Terms. However, the Platform may contain links to external websites operated by independent service providers who may charge for certain content or services.

The contractual obligation of takeoff.healthcare GmbH is limited to providing the Platform and recruitment services. Takeoff.healthcare GmbH does not guarantee success in your job search and accepts no responsibility for whether or not an employment relationship is established.

Upon successful registration, you receive a non-exclusive and non-transferable licence to use the Platform. The licence is limited to the duration of your account use.

The Platform is provided "as is", with all faults and with the features available in the current version. There is no entitlement to minimum availability or error-free operation. Takeoff.healthcare GmbH will make reasonable efforts to resolve any reported issues within a reasonable timeframe.

The content and information on this Platform and the infrastructure used to deliver it are our property. You agree that you will not:

• Modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, transfer, sell, resell or otherwise use this content in violation of this Agreement.

• Use this Platform or its content for commercial purposes.

• Use automated means or manual processes to monitor or copy content from this Platform without our express written permission.

• Take measures that impose an unreasonable or disproportionately large load on our infrastructure.

• Create deep links to any part of this Platform without our express written permission.

• Frame or mirror parts of this Platform without prior written permission.

• Attempt to modify, translate, adapt, edit, decompile, disassemble or reverse-engineer any software used by takeoff.healthcare GmbH in connection with the Platform.

You acknowledge that entering into and performing this Agreement results in the processing of your personal data by takeoff.healthcare GmbH. This includes personal master data, applicant data, your usage behaviour on the Platform, and your experience reports regarding (interested) employers.

By entering into this Agreement, you consent to the transfer of your applicant data to interested employers. References will only be requested if you have given express consent.

You also consent that takeoff.healthcare GmbH may evaluate your usage behaviour and shared experience reports to improve our services, show you better-matched vacancies, and provide employers with anonymised evaluations.

Account users acknowledge and accept that upon permanent deletion of their account, all personal information — including email addresses, names, applicant data and registered reviews — will be irrevocably deleted.

Takeoff.healthcare GmbH excludes its own liability and that of its auxiliary persons to the extent permitted by law. Takeoff.healthcare GmbH is only liable for direct and intentional or grossly negligent breaches of obligations in connection with the Platform.

Takeoff.healthcare GmbH is in no way liable for misconduct or breaches of obligations by potential or placed employers. You must submit all claims arising from or in connection with the placed employment relationship or job interview to the relevant employer.

Takeoff.healthcare GmbH is not liable for damage you suffer as a result of using the Platform in violation of the law or this Agreement.

You agree to indemnify and defend takeoff.healthcare GmbH, its subsidiaries and all their employees and representatives from and against all claims, demands, losses, damages, fines, costs or other expenses (including reasonable legal costs) brought against takeoff.healthcare GmbH by third parties due to breaches by you of this Agreement, any violation by you of any law or rights of third parties, or your use of this Platform.

This Platform may contain hyperlinks to websites operated by parties other than takeoff.healthcare GmbH. These hyperlinks are provided solely for your convenience. We have no control over these websites and are not responsible for their content, privacy policies or other practices.

You are responsible for taking the necessary precautions to ensure that links you select or software you download are free from viruses, worms, Trojan horses, defects and other harmful elements.

The inclusion of hyperlinks does not imply endorsement of the material on these websites or any association with their operators.

You grant takeoff.healthcare GmbH an irrevocable, royalty-free, perpetual, exclusive, worldwide licence to use, copy, reproduce, publish, perform, sell, display, distribute or otherwise exploit your reviews of employers and testimonials.

You may not copy, use, reproduce, publish, perform, display or distribute any content owned by or on which takeoff.healthcare GmbH holds intellectual property rights without prior written permission.

Takeoff.healthcare GmbH may make changes, additions or removals to these Terms at its sole discretion when deemed necessary.

Takeoff.healthcare GmbH may modify, restrict, suspend or terminate any aspect of its services, including the availability of features, databases or content, without prior notice or liability.

We will inform you of changes to these Terms in text form. By continuing to use our services, you agree to the changes. If you do not agree, please contact us so that we can delete your account and, if necessary, your data.

This Agreement is governed by Swiss law, excluding conflict-of-law rules. The exclusive competent court for all disputes between takeoff.healthcare GmbH and you is — subject to mandatory jurisdiction rules — Lucerne.

If one or more provisions of this Agreement are void or invalid, this does not affect the validity of the remaining provisions. Void or invalid provisions will be replaced by legally valid provisions that most closely reflect the economic purpose of the void or invalid provisions.

This Agreement and all other terms referenced herein constitute the entire agreement between you and takeoff.healthcare GmbH regarding this Platform.
